????新京報(bào)記者3月30日獲悉，去年被批捕的齊魯證券前員工彭晨日前已被萊蕪市鋼城區(qū)人民檢察院正式起訴，起訴的原因是涉嫌非法吸收公眾存款。據(jù)彭晨代理律師袁軍透露，彭晨此次是以個(gè)人犯罪被起訴的，起訴并未涉及齊魯證券，對(duì)此彭晨一方表示不認(rèn)可。

????批捕一年后遭起訴

????因涉嫌非法吸收公眾存款被批準(zhǔn)逮捕將近一年后，齊魯證券前員工彭晨日前被萊蕪市鋼城區(qū)人民檢察院正式起訴。

????彭晨的代理律師北京中兆律師事務(wù)所律師袁軍昨日向新京報(bào)證實(shí)，他已經(jīng)于3月20日拿到了起訴書。根據(jù)起訴書，檢察院起訴罪名是涉嫌非法吸收公眾存款，值得關(guān)注的是彭晨此次是以個(gè)人罪名被起訴的，起訴并未涉及老東家齊魯證券。

????“起訴書說彭晨個(gè)人吸收公眾存款，對(duì)于以個(gè)人犯罪起訴這點(diǎn)我們是不認(rèn)可的，公安和檢查機(jī)關(guān)進(jìn)行了這么長時(shí)間的調(diào)查，收集了那么多的證據(jù)，最后卻以個(gè)人犯罪起訴，我們不認(rèn)可，我們認(rèn)為彭晨是職務(wù)行為。”袁軍說。

????2014年4月25日，彭晨因涉嫌非法吸收公眾存款被警方帶走，此后被山東銀山公安局拘留；2014年6月1日，彭晨被警方批準(zhǔn)逮捕。

?????曾透露齊魯證券讓其“背黑鍋”

????42歲的彭晨曾是齊魯證券的員工，2012年加入齊魯證券零售業(yè)務(wù)部，任該部門的副總經(jīng)理，主要負(fù)責(zé)財(cái)富管理部的創(chuàng)新業(yè)務(wù)。2014年年初彭晨向齊魯證券提交了辭職書。

????據(jù)記者獲悉，彭晨被帶走源于其任職期間牽頭發(fā)起的私募產(chǎn)品，即有節(jié)1號(hào)和有節(jié)2號(hào)，有節(jié)1號(hào)總產(chǎn)品規(guī)模為7877萬元，齊魯證券客戶募集規(guī)模2000萬元；有節(jié)2號(hào)總產(chǎn)品規(guī)模為7739萬元，齊魯證券客戶募集規(guī)模2698萬元。兩款產(chǎn)品于2014年4月24日到期后出現(xiàn)無法兌付的麻煩。在這種情況下，山東萊蕪的一位客戶向公安機(jī)關(guān)舉報(bào)了彭晨。

????彭晨在被帶走前向媒體透露，上述案子是齊魯證券的公司行為，自己只是產(chǎn)品負(fù)責(zé)人之一，齊魯證券有意讓其“背黑鍋”。

????齊魯證券則稱該案為彭晨個(gè)人行為。齊魯證券總裁畢玉國在彭晨被帶走之后曾公開表示，齊魯證券本身沒有涉及“私募理財(cái)產(chǎn)品合作模式”相關(guān)產(chǎn)品對(duì)外推廣、銷售的情況。
